Transactions and agreements are only binding on us once we have confirmed them in writing. All offers, discounts, bonuses etc. are subject to confirmation. All offers are made subject to the goods being unsold. Subsidiary agreements are only binding if confirmed in writing. Sales from batches that have not yet arrived are only binding, once we have received delivery of the goods ourselves.

All consignments, including any returns, are at the customer’s expense. The customer accepts the risk,
as soon as the goods have been entrusted to a freight forwarder, the railways, postal service or another freight moving company. Withholding payments due to claims made by the customer is not permissible.

An ability to pay is assumed for all transactions. If a customer’s financial situation deteriorates, we reserve the right to supply only in return for cash in advance or COD. Any delay in customer payments is grounds for us to assume that their financial situation has deteriorated.

Any defects, of which the customer is always under obligation to furnish proof, are to be submitted to the court at the place where they are delivered. All supplied goods remain our property until they are paid for in full. If the customer delays payment, it is their obligation to provide an accurate list of reserved goods. This also applies to goods that have undergone further processing (extended retention of title).
